[...] erect and build and fully finishe one or more water mill or mills in some convenient place or places uppon his ma[ies]t[ie]s lands within the said late Cittie or lib[er]ties thereof and that the said Symon Henry and Robert or one of them or some other able and sufficient ten[a]nt with his family shall from time to time after the building of the said house during the residue of the said terme of one and twenty yeares be resident and inhabitant in and uppon the said house and shall keepe and mainteine the aforesaid house [and] mills [and] all edifices and buildings w[hi]ch now are or hereafter during the said terme shal[l] be uppon the aforesaid p[re]misses or shal[l] be made or erected as aforesaid by the said Symon Henry and Robert or anie of them their or either of their assignes according unto or by vertue of this agreement in good and sufficient rep[ar]ac[i]ons and shall within three yeares now next comeing sett and make all the inclosures of and uppon the foresaid p[re]misses with dike and double quicksett and soe keepe and mainteine the same well [and] sufficiently fenced ditched and inclosed during the said terme and that the said Symon Henry and Robert and their assignes shall during the said terme have and keepe in readines uppon the p[re]misses for the service of his ma[ies]tie his heires and successors one pike and corslett furnished in such manner as the same shal[l] be allowed of by the mustermaster of the place where the p[re]misses are for the time being and the said Simon Henry and Robert and their assignes shall from time to time during the said terme have assigned and sett out unto them uppon reasonable request by the Woodward or other officer of his ma[ies]tie his heires and successors soe much good and sufficient roughe timber in convenient places within the late countie of Londonderry to be cutt downe and brought away att the chardges of the said Simon Henry and Rob[er]t and their assignes as shal[l] be sufficient for the building of the said mill and house And shall yearly during the said terme sett and plant uppon some part of the foresaid p[re]misses two young trees of oake or ashe fitt or likely to grow to be timber trees and the same or others to be sett or planted in the roome and steed of such of them as shall happen to dye shall mainteine p[re]serve and keepe from hurt and spoile during the said terme And that his ma[ies]tie wil[l] be gratiously pleased to confirme this agreement by his l[ett]res patents under the great Seale of England and that the s[ai]d Symon Henry and Robert shall coven[a]nt and grant thereby for them their heires executors administrators and assignes to p[er]forme what is hereby agreed on their parts And it is hereby declared that this contract and agreem[en]t is made by the said Commission[er]s with the said Simon Henry and Robert as trustees for the benefitt of such Corporac[i]on as his ma[ies]tie shal[l] be pleased to make in the said late Citty In witnes whereof the said Commissioners and the said Simon, Henry, and Robert have putt to their hands the day and yeare abovewritten:

The said one and thirtieth day of August the said Commissioners for and on his ma[ies]t[ie]s behalfe by vertue of the said Commission and George Downing of Ballikelley in the late countie of Londonderry gent[leman] doe conclude and agree that the said George Downing and his assignes shall have and hold one messuage or Tenem[en]t and the garden and backside thereunto belonging with th[e] app[ur]ten[a]nc[e]s in Queenestreete in the said late Citty and allsoe one peece or parcell of land conteining by estimac[i]on ffifteene acres and an halfe Irishe measure with th[e] appurten[a]nc[e]s neere Bally mc Rorty within the lib[er]ties of the said late Citty all w[hi]ch p[re]misses now are or late were in the tenure or occupac[i]on of the said George Downing and Mathias Browne or one of them their or one of their assignes with all waies and passages unto the p[re]misses or anie part thereof belonging or formerly enioyed therewith w[i]th the like excepc[i]ons and for the terme of one and twenty yeares from the ffeast of the Annunciac[i]on of the blessed Virgin Mary now last past for and under the yearly rent of Twelve pounds and ffive shillings sterling paiable in such manner and att such dayes [and] times and with under and uppon such further and the like condic[i]on coven[a]nts and agreements as in the foresaid agreem[en]t made by the said Commissioners and John Kneeland beforenamed are conteined In witnes whereof the said Commissioners and the said George Downing have put to their hands the day and yea r abovewri tten:

[…] erect and build and fully finish one or more water-mill or mills in some convenient place or places upon His Majesty’s lands within the said late city or Liberties thereof, and that the said Simon, Henry, and Robert or one of them or some other able and sufficient tenant with his family shall, from time to time after the building of the said house, during the residue of the said term of one and twenty years, be resident and inhabitant in and upon the said house and shall keep and maintain the aforesaid house and mills and all edifices and buildings which now are, or hereafter during the said term shall be, upon the aforesaid premises, or shall be made or erected as aforesaid by the said Simon, Henry, and Robert or any of them, their, or either of their assigns according unto or by virtue of this agreement, in good and sufficient reparations, and shall within three years now next coming set and make all the enclosures of and upon the foresaid premises with dikes and double quicksett, and so keep and maintain the same well and sufficiently fenced, ditched, and enclosed during the said term, and that the said Simon, Henry, and Robert and their assigns shall, during the said term, have and keep in readiness upon the premises for the service of His Majesty, his heirs and successors one pike and corslet furnished in such manner as the same shall be allowed of by the Muster Master of the place where the premises are for the time being, and the said Simon, Henry, and Robert and their assigns shall, from time to time during the said term, have assigned and set out unto them upon reasonable request, by the Woodward or other Officer of His Majesty, his heirs and successors, so much good and sufficient rough timber in convenient places within the late county of Londonderry, to be cut down and brought away at the charges of the said Simon, Henry, and Robert and their assigns, as shall be sufficient for the building of the said mill and house. And shall yearly during the said term set and plant upon some part of the foresaid premises two young trees of oak or ash fit or likely to grow to be timber trees, and the same or others to be set or planted in the room and stead of such of them as shall happen to die shall maintain, preserve, and keep from hurt and spoil during the said term. And that His Majesty will be graciously pleased to confirme this agreement by his letters patent under the Great Seal of England, and that the said Simon, Henry, and Robert shall covenant and grant thereby for them, their heirs, executors, administrators, and assigns to perform what is hereby agreed on their parts. And it is hereby declared that this contract and agreement is made by the said commissioners with the said Simon, Henry, and Robert as trustees for the benefit of such corporation as His Majesty shall be pleased to make in the said late city. The said one and thirtieth day of August, the said commissioners for and on His Majesty’s behalf by virtue of the said commission, and George Downing of Ballykelly in the late county of Londonderry, gentleman, do conclude and agree that the said George Downing and his assigns shall have and hold one messuage or tenement and the garden and backside thereunto belonging, with the appurtenances, in Queens Street in the said late city, and also one piece or parcel of land containing by estimation ffifteen acres and an half Irish measure, with the appurtenances, near Bally McRorty within the Liberties of the said late city, all which premises now are or late were in the tenure or occupation of the said George Downing and Mathias Brown or one of them, their, or one of their assigns, with all ways and passages unto the premises or any part thereof belonging or formerly enjoyed therewith, with the like exceptions and for the term of one and twenty years from the feast of the Annunciation of the Blessed Virgin Mary now last past, for and under the yearly rent of twelve pounds and five shillings sterling payable in such manner and at such days and times and with, under, and upon such further and the like condition, covenants, and agreements as in the foresaid agreement made by the said commissioners and John Kneeland beforenamed are contained.
