M ajesty shall erect, create, or make upon or within the said Proportion from three weekes to three weekes if the same shall be so often held and shall during the said Terme keepe susteyne and maintain the aforesaid Messuages and all other the aforesaid buildings in go od and sufficient rep[ar]ac[i]ons And shall within seaven yeares now next com[m]ing with dikes and double quicksett where quicksett will growe and with other good and sufficient ffences and enclosures where quicksett will not grow divide sever, and make the aforesaid p[re]misses into twelve several closes more then the same now are and the same beinge soe devided made and severed And all other fences ditches [and] Inclosures up[p]on or belonging to the aforesaid premises shall keepe, and maintaine we ll and sufficiently ffenced, ditched enclosed and quicksetted duringe the said Terme and shall yearly duringe the said Terme s et and plant up[p]on some p[ar]tes of the aforesaid p[re]misses twelve young trees of oak or ashe fitt and likely to growe, to be tymber trees and the same or others to be sett and planted in the roomes and steads of such of them as shall happen to dye shall maintaine p[re]serve and keepe from hurt and spoil duringe the said Terme And shall att hi s and their p rop er costs and charges duringe the said Terme have and keep in readin ess upon the aforesaid p[re]misses for the service of his Ma jesty his heyres and Successors one pike and corslett furnished in suc h manner as the same shall and may be allowed by the Mustermas ter of the said County in which the p[re]misses are for the tyme beinge. And that his Majesty will be gratiously pleased to ratifye and confirme this Agreem ent by his Letters Patents under the great seale of England and that the said Richard shall covenant and grannt thereby for him his heires Executors Administrators and assignes to p[er]forme what is hereby agreed on his part In Wittnes whereof the said Com[m]issioners and the said Richard Griffin have putt to their hands the day and yeare abovewritten:

The said second day of September the said Com[m]issioners for and on his Majesty’s behalfe by vertue of the said Com[m]ission and Robert Downes of the parishe of ffaughenvale in the late County of Londonderry gent[leman] do conclude and agree that the said Robert and his assignes shall have and hold All those two Townelands com[m]only called or knowne by the severall name or names of ffallalough and Tullanregh w[i]th the appurten[an]c[e]s in ffaughenvale aforesaid or by whatsoever other name or names the same or either of them be called or knowne and conteining by estimac[i]on one hundred threescore and twelve acres Irishe measure And all edifices and buildings thereup[p]on and allso all waies [and] passages to the aforesaid p[re]misses or any part thereof belonging or formerly enioyed therewith Exceptinge and reservinge unto his Ma[ies]tie his heyres and Successors All tymber, and tymber trees storiers, saplinges and great trees Mynes and quarries in up[p]on or belonginge to the p[re]misses or any part thereof And all such reasonable waies and passages over the p[re]misses for the Ten[a]nts and Occupyers of his Ma[ies]t[ie]s other lands as have formerly beene used And all the River of Loughfoyle and all other Rivers Creekes and streames in or neere the p[re]misses and the soil

And shall, within seven years now next coming, with dikes and double quicksett where quicksett will grow and with other good and sufficient fences and enclosures where quicksett will not grow, divide, sever, and make the aforesaid premises into twelve several closes more than the same now are, and the same being so divided, made, and severed and all other fences, ditches, and enclosures upon or belonging to the aforesaid premises shall keep and maintain well and sufficiently fenced, ditched, enclosed, and quicksetted during the said term, and shall yearly during the said term set and plant upon some parts of the aforesaid premises twelve young trees of oak or ash fit and likely to grow to be timber trees, and the same or others to be set and planted in the rooms and steads of such of them as shall happen to die shall maintain, preserve, and keep from hurt and spoil during the said term. And shall, at his and their proper costs and charges during the said term, have and keep in readiness upon the aforesaid premises for the service of his Majesty, his heirs and successors one pike and corslet furnished in such manner as the same shall and may be allowed by the Muster Master of the said county in which the premises are for the time being. And that his Majesty will be graciously pleased to ratify and confirm this agreement by his letters patent under the Great Seal of England, and that the said Richard shall covenant and grant thereby for him, his heirs, executors, administrators, and assigns to perform what is hereby agreed on his part. Robert Downs

The said second day of September, the said commissioners for and on his Majesty’s behalf by virtue of the said commission, and Robert Downs of the parish of Faughanvale in the late county of Londonderry, gentleman, do conclude and agree that the said Robert and his assigns shall have and hold all those two townlands commonly called or known by the several name or names of Falloward and Tullanee, with the appurtenances, in Faughanvale aforesaid or by whatsover other name or names the same or either of them be called or known, and containing by estimation one hundred three-score and twelve acres Irish measure. And all edifices and buildings thereupon, and also all ways and passages to the aforesaid premises or any part thereof belonging or formerly enjoyed therewith. Excepting and reserving unto his Majesty, his heirs and successors all timber and timber trees, storiers, saplings and great trees, mines, and quarries in, upon, or belonging to the premises or any part thereof and all such reasonable ways and passages over the premises for the tenants and occupiers of his Majesty’s other lands as have formerly been used. And all the River of Foyle and all other rivers, creeks, and streams in or near the premises and the soil
