The thirteenthe day of September in the ffifteenthe yeare of his ma[ies]t[ie]s reigne Annoq[ue] D[omi]ni 1639 the aforesaid S[i]r Raphe Whitfeld and Thomas ffotherley his ma[ies]t[ie]s Commissioners for and on his ma[ies]t[ie]s behalfe by vertue of the said Commission and Thomas Churche of Mavonihur in the late county of Londonderry Esquire do conclude and agree that his Ma[ies]tie wil[l] be gratiously pleased to erect and create a Court Leete w[hi]ch shall extend and have jurisdic[i]on over all the residents and inhabitants within the late Mannor of Mercers and Proportion of land called the Mercers Proporc[i]on in the said late county of Londonderry to be houlden twice every year as leets are or ought to be houlden in England and that the said Thomas Churche and his assigns shall have and hold the said Court Leete and all the ffines issues amerc[ia]m[en]ts and profitts thereof and also all that capital messuage or Mannor house with th[e] appurten[a]nc[e]s commonly called or knowne by the name of [...] or by whatsoever other name or names the same be called or knowne and all barns stables outhouses and buildings orchards and gardens now in the occupac[i]on of the said Thomas Churche or his assigns and to the said capitall messuage or Mannor house belonging and all those eight townlands with th[e] appurten[a]nc[e]s called or knowne by the several name or names of over and back againe all men horses cowes corne graine chattell goods and all other things whatsoever portable on the said river of Bann att the places aforesaid and to receive and take for such ferrying, transporting, and carrying over and uppon the passage and fferry aforesaid all such fares rewards sums of money, profits, and commodities as usually heretofore have binn received had and and ground thereof and all the ffishings and takeing of Sallmons Eeles and other ffishe in the said rivers creekes and streames with free lib[er]ty for his ma[ies]tie his heires and successors and his The thirteenth day of September in the fifteenth year of his Majesty’s reign, annoque domini 1639, the aforesaid Sir Ralph Whitfeld and Thomas Fotherley, his Majesty’s commissioners for and on his Majesty’s behalf by virtue of the said commission, and Thomas Church of Movanagher in the late county of Londonderry, esquire, do conclude and agree that his Majesty will be graciously pleased to erect and create a court leet which shall extend and have jurisdiction over all the residents and inhabitants within the late Manor of Mercers and Proportion of land called the Mercers’ Proportion in the said late county of Londonderry, to be holden twice every year as leets are or ought to be holden in England, and that the said Thomas Church and his assigns shall have and hold the said court leet and all the fines, issues, amerciaments, and profits thereof, and also all that capital messuage or manor house with the appurtenances commonly called or known by the name of […] or by whatsoever other name or names the same be called or known, and all barns, stables, outhouses and buildings, orchards and gardens now in the occupation of the said Thomas Church or his assigns and to the said capital messuage or manor house belonging, and all those eight townlands with the appurtenances called or known by the several name or names of Movanagher, […]crim, Tamlaght, Mullal[…], Ballin[…], Lismoyle, and Tirnaconway, and all cabins, edifices, and buildings thereupon, and all ways and passages unto the said premises or any part thereof belonging or therewith formerly enjoyed. Excepting and always reserving to his Majesty, his heirs and successors all donations, presentations, and gifts of advowsons, churches, vicarages, chapels, timber and timber trees, storiers, saplings and great trees, mines and quarries in, upon, belonging, or appendant to the premises or any part thereof, and all such reasonable ways and passages over the premises for the tenants and occupiers of his Majesty’s other lands as have formerly been used, and all the River of the Bann, and all rivers, creeks, and streams in the foresaid premises or any part thereof, and the soil and ground thereof, and all the fishings and taking of salmon, eels, and other fish in the said rivers, creeks, and streams with free liberty for his Majesty, his heirs and successors, and his and their tenants and farmers and the fishers of the said rivers, creeks, streams, and fishings to make houses and draw their nets and do any other thing else whatsoever upon the premises concerning the said fishings.
