his and their proper costs and charges during the said term have and keep in readiness for the service of his Majesty his heirs and successors three corslets and pikes and two muskets furnished in such manner as the same shall and may be allowed by the muster mas ter of the said county for the tyme being in w[hi]ch the premises are and that uppon reasonable request there shal[l] be allowed and sett out unto [th]e said S[i]r Thomas Staples or his assignes from tyme to tyme during the said term by the Woodward or other officer of his ma[ies]tie his heires and successors rough timber for building and repairing the aforesaid houses and buildings and houseboote and allsoe that he or they shall have and take other wood for ploughboote and C artboote [...] uppon the aforesaid p[re]misses to be spent uppon the p[re]misses and not else where And that the said S[i]r Thomas Staples and his assignes shall within three years now next comeing fence inclose and encoppice with dike and double quicksett twelve acres Irish measure of the woods and wood grounds p[ar]cell of the said Towneland called Turnigarwell als[o] Terr[...] and twelve acres more Irish measure of the woods and wood grounds p[ar]cell of the said Towneland called Amforglane and allsoe twelve acres more Irish measure of the woods and wood grounds p[ar]cell of the foresaid Towneland called or knowne by the name of [...] same fences and inclosures shall well and sufficiently keep and preserve during the aforesaid terme of one and twenty yeares and allsoe the [...] acres soe as aforesaid to be inclosed shall during the said terme preserve and keep as coppice woods from hurt and spoile and uppon every fell that shall be made thereof or any p[ar]t thereof shall new incoppice fence and inclose the same and shall allsoe p[re]serve and keepe uppon every felling and cutting of every [...] the said woods soe to be incoppiced as aforesaid ffourty young storiers [and] thirty standalls of oake and ashe fitt to make timber trees. And it is further agreed that his Majesty will be gratiously pleased to ratifie and confirme this agreement by his letters patents under the great Seale of England and that the said Sir Thomas Staples shall coven[a]nt and grannt thereby for him his heires executo[rs] administrators and assignes to p[er]forme what is hereby agreed on his parte. The said ffive and twentieth day of July the aforesaid Commissioners for and on his ma[ies]t[ie]s behalfe by vertue of the said Commission and ffranncis Barnaby of Aghhaddowed in the late county of Londonderry gent[leman] doe conclude and agree that [th]e said ffranncis Barnaby and his assignes shall have and hold one messuage or tenem[en]t building orchard and garden w[i]th th[e] appurten[a]nc[e]s and one towneland commonly called or knowne by the name of Carballinttubber or by whatsoever other name or names the same be called or knowne by and conteining by estimac[i]on of land meadow pasture woodland and bogg one hundred thirty and nine acres Irish measure in the parishe of Dersert Toughell and now or late in the tenure or occupac[i]on of the said ffranncis Barnaby or his assignes and allsoe all waies and passages to the aforesaid p[re]misses or any part thereof belonging or formerly enioyed therewith. Excepting and res[er]ving to his ma[ies]tie his heires and successors all timber and timber trees storiers saplings and great trees mines and quarries in uppon or belonging to the foresaid

And that the said Sir Thomas Staples and his assigns shall within three years now next coming fence, enclose, and encoppice with dikes and double quicksett twelve acres Irish measure of the woods and wood grounds parcel of the said townland called Turnigarwell also Terr[…] [Tirgarvil], and twelve acres more Irish measure of the woods and woodgrounds parcel of the said townland called Upperland, and also twelve acres more Irish measure of the woods and woodgrounds parcel of the foresaid townland called or known by the name of […], same fences and enclosures shall well and sufficiently keep and preserve during the aforesaid term of one and twenty years, and also the […] acres so as aforesaid to be enclosed, shall during the said term preserve and keep as coppice woods from hurt and spoil, and upon every fell that shall be made thereof or any part thereof shall new encoppice, fence, and enclose the same, and shall also preserve and keep upon every felling and cutting of every […] the said woods, so to be encoppiced as aforesaid, forty young storiers and thirty standalls of oak and ash fit to make timber trees. And it is further agreed that his Majesty will be graciously pleased to ratify and confirm this agreement by his letters patent under the Great Seal of England, and that the said Sir Thomas Staples shall covenant and grant thereby for him, his heirs, executors, administrators, and assigns to perform what is hereby agreed on his part. The said five and twentieth day of July, the aforesaid commissioners for and on his Majesty’s behalf by virtue of the said commission, and Francis Barnaby of Aghadowey in the late county of Londonderry, gentleman, do conclude and agree that the said Francis Barnaby and his assigns shall have and hold one messuage or tenement building, orchard, and garden, with the appurtenances, and one townland commonly called or known by the name of Carbalintober, or by whatsoever other name or names the same be called or known by and containing by estimation of land, meadow, pasture, woodland, and bog, one hundred thirty and nine acres Irish measure in the parish of Desertoghill, and now or late in the tenure or occupation of the said Francis Barnaby or his assigns, and also all ways and passages to the aforesaid premises or any part thereof belonging or formerly enjoyed therewith. Excepting and reserving to his Majesty, his heirs and successors all timber and timber trees, storiers, saplings and great trees, mines and quarries in, upon, or belonging to the foresaid
