one [...] said late Citty doe conclude and agree that the said Robert Thomson and his assigns shall have and hold one wynd mill and one horse mill in the Island of Derry with th[e] appurten[a]nc[e]s within the Liberties of the said late Citty and now in the houlding of the said Robert and John and allsoe all the moulture soake and grinding of mault corne and agraine att and in the said mills and in the other mills as according to this agreement are to be built and erected for all the ten[a]nts and inhabitants of his ma[ies]t[ie]s houses and lands w[hi]ch are within the late Citty of Londonderry or the lib[er]ties thereof lyeing on that side of the river of Loughfoile on w[hi]ch the said late Citty is built, and all watercourses waies and passages to the mills to be erected according to this agreement and all those severall peeces and parcells of land with th[e] appurten[a]nc[e]s conteining by estimac[i]on seaven acres of Irishe measure and now or late in the severall tenures or occupac[i]ons of the said Rob[er]t Thornton and John Ellvyn and of Samuell Dawson John Hawkes John Palm[er] John Boyd John Kneeland Henry Sollers Richard Burdus Henry Addison Gabriell Larggs Walter Hamilton Richard Mutter John Westgate George Sanders Richard Morrice and Dame Ann Brooke widdow or their or some of their assignes and are lyeing and being together in the Island of Derry and all waies and passages unto the foresaid p[re]misses or anie p[ar]t thereof belonging or formerly enioyed therewith for the terme of one and twenty yeares from the ffeast of Th[e] an[n]unciac[i]on of the blessed virgin Mary now last past for and under the yearly rent of Twenty pounds sterling for the first yeare of the said one and twenty yeares paiable att the ffeasts of Th[e] an[n]unciac[i]on of the blessed virgin Mary now next ensueing and for and under the yearly rent of ffourty pounds sterling for the last twenty yeares residue of the said one and twenty yeares paiable att the ffeast of St Michaell Th[e] archangell Th[e] archangell and Th[e] an[n]unciac[i]on of the blessed virgin Mary by equall porc[i]ons the said rent to be paid unto his ma[ies]tie his heires and successors into the receipt of his ma[ies]t[ie]s Excheq[uer] in England or unto the hands of the Receivor of his ma[ies]tie his heires and successors for the tyme being for the Reven[n]ue of Londonderry als[o] Derry and Colerane or either of them Uppon condic[i]on the said terme shall cease and be voyd if the said rent or any p[ar]t thereof shall be behind and unpaid by the space of ffifty daies next after anie of the said ffeasts or dayes of paiment aforesaid And the said Robert Thornton and John Ellvyn or their assignes shall att his or their p[ro]p[er] costs and chardges w[i]thin three yeares now next comeing erect and build and fully finishe uppon the p[re]misses one sufficient dwelling house of timber stone or bricke after the manner of an Englishe house two stories highe att the least and to conteine fower roomes att the least and shall allsoe within the said three yeares erect and build and fully finishe one or more water mill or mills in some convenient place or places uppon his ma[ies]t[ie]s lands within the said late Citty and lib[er]tyes thereof and that the said Robert and John or one of them or some other able and sufficient Ten[a]nt with his family shall from tyme to tyme after the building of the said house during the residue of the said terme of one and twenty yeares be resident and inhabitant in and uppon the said house and shall keepe and mainteine the aforesaid house and mills and all edifices and buildings w[hi]ch now or hereafter during the said terme shal[l] be uppon the said p[re]misses or shal[l] be made or erected as aforesaid by the said Robert and John or either of them their or either of their assignes according unto or by vertue of this agreement in good and sufficient rep[ar]ac[i]ons and shall within three yeares now next ensueing sett and make all the inclosures of and uppon the aforesaid p[re]misses with dike and double quicksett and keepe and mainteine the same well and sufficiently fenced ditched and inclosed during [th]e said terme and that the said Robert and John and their assignes shall during the said terme have and keepe in readines uppon the p[re]misses for the service of his ma[ies]tie his heires and successors one pike and corslett furnished in such manner as the same shal[l] be allowed by the muster master of the place where the p[re]misses are for the tyme being and the said Robert and John and their assignes shall from tyme to tyme during the said term have assigned and sett out unto them upon reasonable request by the Woodward or other officer of his ma[ies]tie his heirs and successors so much good and sufficient rough timber in convenient places within the late

one […] said late city, do conclude and agree that the said Robert Thomson and his assigns shall have and hold one windmill and one horsemill in the Island of Derry, with the appurtenances, within the Liberties of the said late city and now in the holding of the said Robert and John, and also all the multure, soak, and grinding of malt, corn, and grain at and in the said mills and in the other mills as, according to this agreement, are to be built and erected for all the tenants and inhabitants of His Majesty’s houses and lands which are within the late city of Londonderry or the Liberties thereof, lying on that side of the River of Foyle on which the said late city is built, and all watercourses, ways, and passages to the mills to be erected according to this agreement, and all those several pieces and parcels of land, with the appurtenances, containing by estimation seven acres of Irish measure and now or late in the several tenures or occupations of the said Robert Thornton and John Elvin and of Samuel Dawson, John Hawkes, John Palmer, John Boyd, John Kneeland, Henry Sollers, Richard Burdus, Henry Addison, Gabriel Larggs, Walter Hamilton, Richard Mutter, John Westgate, George Sanders, Richard Morrice, and Dame Anne Brook, widow, or their, or some of their assigns, and are lying and being together in the Island of Derry, and all ways and passages unto the foresaid premises or any part thereof belonging or formerly enjoyed therewith, for the term of one and twenty years from the feast of the Annunciation of the Blessed Virgin Mary now last past, for and under the yearly rent of twenty pounds sterling for the first year of the said one and twenty years, payable at the feasts of the Annunciation of the Blessed Virgin Mary now next ensuing, and for and under the yearly rent of forty pounds sterling for the last twenty years residue of the said one and twenty years, payable at the feast of St Michael the Archangel and the Annunciation of the Blessed Virgin Mary by equal portions, the said rent to be paid unto His Majesty, his heirs and successors, into the receipt of His Majesty’s Exchequer in England, or unto the hands of the Receiver of His Majesty, his heirs and successors for the time being, for the revenue of Londonderry, also Derry, and Coleraine or either of them. Upon condition the said term shall cease and be void if the said rent or any part thereof shall be behind and unpaid by the space of fifty days next after any of the said feasts or days of payment aforesaid. And the said Robert Thornton and John Elvin or their assigns shall, at his or their proper costs and charges, within three years now next coming erect and build and fully finish upon the premises one sufficient dwelling house of timber, stone, or brick after the manner of an English house two stories high at the least and to containe four rooms at the least, and shall also within the said three years erect and build and fully finish one or more water-mill or mills in some convenient place or places upon His Majesty’s lands within the said late city and Liberties thereof, and that the said Robert and John or one of them or some other able and sufficient tenant with his family shall, from time to time after the building of the said house, during the residue of the said term of one and twenty years be resident and inhabitant in and upon the said house, and shall keep and maintain the aforesaid house and mills and all edifices and buildings which now or hereafter during the said term shall be upon the said premises, or shall be made or erected as aforesaid by the said Robert and John or either of them, their, or either of their assigns, according unto or by virtue of this agreement, in good and sufficient reparations, and shall within three years now next ensuing set and make all the enclosures of and upon the aforesaid premises with dikes and double quicksett and keep and maintain the same well and sufficiently fenced, ditched, and enclosed during the said term, and that the said Robert and John and their assigns shall during the said term have and keep in readiness upon the premises for the service of His Majesty, his heirs and successors, one pike and corslet furnished in such manner as the same shall be allowed by the Muster Master of the place where the premises are for the time being, and the said Robert and John and their assigns shall from time to time during the said term have assigned and set out unto them upon reasonable request, by the Woodward or other officer of his Majesty, his heirs and successors, so much good and sufficient rough timber in convenient places within the late
