one sufficient and substantial house of timber stone or bricke after the manner of an English house two stories high and contayneinge ffower roomes at the least and the said Alexander Thomas and Gilbert or some other able and sufficient ten[a]nt with his famylie shall from time to time dureinge the said terme of yeares bee resident and inhabitant in and upon the foresaid premisses, and shall dureinge the said terme grinde at his Ma[ies]t[ie]s Mill within the late Mannor of Wallworth or p[ro]porc[i]on of land called the ffishmongers proporc[i]on in the said late Countie of London derry All his and their mault corne and graine w[hi]ch hee or they shall expend or use upon the premisses or beinge ground shall sell to any person or persons and pay for grindinge thereof to the Miller of the said Mill for the time beinge the sixteenth parte of all the said Mault corne and graine, and shall doe suite at the court baron to bee holden for such Mannor as his Ma[ies]ty shall erect c reate or make upon or within the said proporc[i]on from three weeks to three weeks if the same shall be soe often held, And shall dureinge the said terme keepe sust ain and maintain the foresaid Messuage and all other the foresaid buildinges in good and sufficient reparac[i]ons And shall within seaven yeares nowe next com ing with dikes and Double quicksett, where quicksett will growe, and w[i]th other go od and sufficient ffences and inclosures where quicksett will not growe divide sever and make the foresaid premisses into ffower severall closes more then the same now are and the same beinge soe divided made and severed and all other the hedges di tches and inclosures upon or belonginge to the foresaid premisses shall keepe and mainteine well and sufficiently fenced ditched and inclosed and quicksetted dureinge the said terme, And shall yearely dureing the said terme sett and plant upon some parte of the foresaid premisses fower younge trees of oake or ashe fitt and likely to growe to be timber trees and the same or others to be sett and planted in the roomes and steads of such of them as shall happen to dye shall mainteine preserve and keepe from hurte and spoile duringe the said terme, And shall at his and their proper costs and charges dureinge the said terme have and keepe in readynesse upon the foresaid premisses for the service of his Ma[ies]ty his heires and successors one Muskett furnished in such manner as the same shall and may be allowed by the Muster Master of the county in w[hi]ch the premisses are for the time beinge, And that upon reasonable request there shal[l] be allowed and sett out unto the said Alexander Thomas and Gilbert and theire assigns from time to time dureinge the said terme by the woodward or other officer of his Majesty his heires and successors rough timber for buildinge and repareinge the foresaid house and howseboot in convenient places within the late County of London Derry to be spent upon the premisses and not elsewhere, And that his Ma[ies]ty w ill be gratiously pleased to ratifie and confirme this agreem[en]t by his Letters Patents under the greate seale of England, And that the said Alexander Thomas and Gilbert shall coven[a]nt and grant thereby for them their heires Executors administrators and assignes to performe what is hereby agreed on theire parts In witnes whereof the said Com[m]issioners and the said A lexander Thomas and Gilbert have put[t] to theire hands the day and yeare abovewritten:

The said ffowerth day of September the said Com[m]issioners for and on his Ma[ies]t[ie]s behalfe by vertue of the said Com[m]ission and Will[ia]m Kyle of ffaughenvale in the late County of London derry yeoman doe conclude and agree that the said William Kyle and his assignes shall have and hold All that towneland com[m]only called or known by the
one sufficient and substantial house of timber, stone, or brick after the manner of an English house two stories high and containing four rooms at the least, and the said Alexander, Thomas, and Gilbert or some other able and sufficient tenant with his family shall, from time to time during the said term of years, be resident and inhabitant in and upon the foresaid premises, and shall during the said term grind at his Majesty’s mill within the late Manor of Walworth or Proportion of land called the Fishmongers’ Proportion in the said late county of Londonderry, all his and their malt, corn, and grain which he or they shall expend or use upon the premises or being ground shall sell to any person or persons, and pay for grinding thereof to the miller of the said mill, for the time being the sixteenth part of all the said malt, corn, and grain, and shall do suit at the court baron to be holden for such manor as his Majesty shall erect, create, or make upon or within the said Proportion from three weeks to three weeks if the same shall be so often held, and shall during the said term keep, sustain, and maintain the foresaid messuage and all other the foresaid buildings in good and sufficient reparations, and shall, within seven years now next coming, with dikes and double quicksett where quicksett will grow and with other good and sufficient fences and enclosures where quicksett will not grow, divide, sever, and make the foresaid premises into four several closes more then the same now are, and the same being so divided, made, and severed and all other the hedges, ditches, and enclosures upon or belonging to the foresaid premises shall keep and maintain well and sufficiently fenced, ditched, and enclosed and quicksetted during the said term, and shall yearly during the said term set and plant upon some part of the foresaid premises four young trees of oak or ash fit and likely to grow to be timber trees and the same or others to be set and planted in the rooms and steads of such of them as shall happen to die shall maintain, preserve, and keep from hurt and spoil during the said term, and shall, at his and their proper costs and charges during the said term, have and keep in readiness upon the foresaid premises for the service of his Majesty, his heirs and successors, one musket furnished in such manner as the same shall and may be allowed by the Muster Master of the county in which the premises are for the time being, and that upon reasonable request there shall be allowed and set out unto the said Alexander, Thomas, and Gilbert and their assigns, from time to time during the said term by the Woodward or other Officer of his Majesty, his heirs and successors, rough timber for building and repairing the foresaid house, and houseboot in convenient places within the late county of Londonderry to be spent upon the premises and not elsewhere, and that his Majesty will be graciously pleased to ratify and confirm this agreement by his letters patent under the Great Seal of England, and that the said Alexander, Thomas, and Gilbert shall covenant and grant thereby for them, their heirs, executors, administrators, and assigns to perform what is hereby agreed on their parts.
