out unto the said Thomas Bacon or his assignes from time to time during the said term by the Woodward or other officer of his ma[ies]tie his heires and successors rough tim ber for building and finishing the foresaid Castle or Capitall house and houseboote in conveni ent places within the late County of Londonderry to be spent uppon the p[re]misses and not elsew here And that the said Thomas Bacon and his assignes shall and may from time to time during the said terme have and take fireboot and hedgeboote to be taken in and upon the roots stumps and truncks of dead trees fallen or lyeing on the ground and not fitt for building thornes bushes shreadings and lopps of trees and underwoods growing uppon the the p[re]misses if the same be there to be had the same to be spent uppon the p[re]misses and not otherwise. And that [th]e said Thomas Bacon and his assignes shall within three yeares now next comeing fence enclose and encoppice with dike and quicksett twentie acres Irishe measure of the woods and woodgrounds p[ar]cell of the foresaid p[re]misses and the same with good and sufficient fences [and] inclosures shall well and sufficiently p[re]serve and keepe during the said terme and allsoe the same twenty acres shall during the said terme p[re]serve and keepe as Coppicewoods from hurt and spoil and uppon every fell that shal[l] be made thereof shall new incopice the same with sufficient fences and inclosures after the manner and usage in England and shall allsoe p[re]serve and keepe upon everie acre of the foresaid twenty acres att everie felling and cutting thereof thirtie young storiers and thirtie standalls of oake and ashe fitt to make timber trees And that his ma[ies]tie wil[l] be gratiously pleased to ratifie and confirme this agreement by his L[ett]res patents under the great Seale of England and that the said Thomas Bacon shall coven[a]nt and grant thereby for him his heires executors administrators and assignes to performe what is hereby agreed on his part In witnes whereof the said Commissioners and the said Thomas Bacon have putt to their hands the day and yeare abovewritten:

The ffive and twentieth day of September in the ffifteeneth yeare of his ma[ies]ties reigne Annoq[ue] D[omi]ni 1639 the foresaid S[i]r Raphe Whitfeld and Thomas ffotherley his ma[ies]t[ie]s Commissioners for and on his ma[ies]t[ie]s behalfe by vertue of the said Commission and Raphe Whistler of Salters Towne in the late countie of Londonderry Esquire Doe conclude and agree that his ma[ies]tie wil[l] be gratiously pleased to erect and create a Court Leete w[hi]ch shall extend and have Iurisdict[i]on over all the residents and inhabitants within the late Mannor of Sal [and] Proporc[i]on of land called the Salters Proporc[i]on in the late county of Londonderry to be houlden within the said Proporc[i]on twice everie yeare as Leetes are or ought to be houlden in England And that the said Raphe Whistler and his assignes shall have and hold the said Court Leete and all the ffines issues amercements and profitts thereof. And allsoe all that Capitall Messuage or Mannor house with th[e] appurten[a]nc[e]s commonly called or knowne by the name of Salters Towne ffort or by whatsoever other name or names the same be called or knowne and all barnes stables outhouses and buildings orchards and gardens now in the occupac[i]on of the said Raphe Whistler and to the said Capitall messuage or Mannor house belonging And all those Townelands halfe-townelands and parcells of land with their appurten[a]nc[es] commonly called or knowne by the severall name or names of Bally-Mulltra Ballidonnell the two Balligillans the two Ballineales Ball[...]arte the two Ballironans Ballirogeldy Balligurke Dremena Gortogurke al[l]s[o] Ballihegelishe Bailireffe Ballimullogon Dunnronan Maghadowyn the halfe Towneland of Ballilifford the halfe Towneland of Augheram Meola Tawna Downarnan Tawney Desert Dowyn Ballinegarrow Lisemnmara Balligerrick Etra and Drummanare and one water corne mill in or neere Salters Towne and the moulture toll and grinding of the mault corne and graine of and for the ten[a]nts of the said Proporc[i]on except onely the ten[a]nts of Seaventeene Townelands w[hi]ch have formerly ground att Magharafelt Mill and all houses cabbins edifices and buildings thereupon all w[hi]ch p[re]misses conteine by estimac[i]on six thousand and two hundred acres Irishe measure and are scituate lyeing and being in DesertMartyn Artra and Tawghlate Killetra or else were in the late countie of Londonderry and allsoe all waifes and Estraies happening within the said late Mannor or Proporc[i]on and allsoe all waies and passages to the foresaid p[re]misses or anie part thereof belonging or formerly enioyed therewith Excepting and allwaies reserving unto his ma[ies]tie his heires and successors All Donac[i]ons p[re]sentac[i]ons and guifts of Advowsons of Churches Viccaridges and Chappells All his ma[ies]t[ie]s woods in Glanconkeyne and Killetra and allsoe all timber and timber trees mynes and quarryes in upon belonging or

And that the said Thomas Bacon and his assigns shall and may from time to time during the said term have and take fireboot and hedgeboot to be taken in and upon the roots, stumps, and trunks of dead trees fallen or lying on the ground and not fit for building, thornbushes, shreddings and lops of trees, and underwood growing upon the the premises if the same be there to be had, the same to be spent upon the premises and not otherwise. And that the said Thomas Bacon and his assigns shall, within three years now next coming, fence, enclose, and encoppice with dikes and quicksett twenty acres Irish measure of the woods and woodgrounds parcel of the foresaid premises, and the same with good and sufficient fences and enclosures shall well and sufficiently preserve and keep during the said term, and also the same twenty acres shall during the said term preserve and keep as coppicewoods from hurt and spoil, and upon every fell that shall be made thereof shall new encoppice the same with sufficient fences and enclosures after the manner and usage in England, and shall also preserve and keep upon every acre of the foresaid twenty acres at every felling and cutting thereof thirty young storiers and thirty standalls of oak and ash fit to make timber trees. And that his Majesty will be graciously pleased to ratify and confirm this agreement by his letters patent under the Great Seal of England, and that the said Thomas Bacon shall covenant and grant thereby for him, his heirs, executors, administrators, and assigns to perform what is hereby agreed on his part. The five and twentieth day of September in the fifteenth year of his Majesty’s reign, annoque domini 1639, the foresaid Sir Ralph Whitfeld and Thomas Fotherley, his Majesty’s commissioners for and on his Majesty’s behalf by virtue of the said commission, and Ralph Whistler of Salters’ Town in the late county of Londonderry, esquire, do conclude and agree that his Majesty will be graciously pleased to erect and create a court leet which shall extend and have jurisdiction over all the residents and inhabitants within the late Manor of Sal and Proportion of land called the Salters’ Proportion in the late county of Londonderry, to be holden within the said Proportion twice every year as leets are or ought to be holden in England. And that the said Ralph Whistler and his assigns shall have and hold the said court leet and all the fines, issues, amerciaments, and profits thereof. And also all that capital messuage or manor house with the appurtenances commonly called or known by the name of Salters’ Town Fort, or by whatsoever other name or names the same be called or known, and all barnes, stables, outhouses and buildings, orchards, and gardens now in the occupation of the said Ralph Whistler and to the said capital messuage or manor house belonging. And all those townlands, half-townlands, and parcels of land with their appurtenances commonly called or known by the several name or names of Ballymultrea, Ballydonnell, the two Balligillans [Ballygillen More], the two Ballineales [Ballyneill More], Ball[…]arte, the two Ballironans [Ballyronan Beg and Ballyronan More], Ballyrogully, Ballygurk, Drumenagh, Gortogurke, also Ballyeglish, Ballyriff, Ballymulligan, Dunronan, Maghadone, the half-townland of Ballylifford, the half-townland of Aughrim, Mullagh, Tonaght, Dunarnon, Tawney, Desert, Dowyn, Ballynagarve, Lisnamorrow, Balligerrick, Etra, and Drumenagh, and one water corn-mill in or near Salters’ Town and the multure toll and grinding of the malt, corn, and grain of and for the tenants of the said Proportion, except only the tenants of seventeen townlands which have formerly ground at Magherafelt mill, and all houses, cabins, edifices, and buildings thereupon, all which premises contain by estimation six thousand and two hundred acres Irish measure, and are situate lying and being in Desertmartin, Artrea, and Tawghlate Killetra or else were in the late county of Londonderry, and also all waifs and strays happening within the said late manor or Proportion, and also all ways and passages to the foresaid premises or any part thereof belonging or formerly enjoyed therewith. Excepting and always reserving unto his Majesty, his heirs and successors all donations, presentations, and gifts of advowsons of churches, vicarages, and chapels, all his Majesty’s woods in Glenconkeyne and Killetra, and also all timber and timber trees, mines, and quarries in, upon, belonging, or
