that is to say that he the said Manus O’Cahan and his assigns shall grind at the said Mill or mills and not e lsewhere all the corn and grain that shall be used or spent in or up[p]on the pr emises or any part thereof and yeildinge and givinge the sixeteenth part thereof for the multure thereof And for default of payinge doinge and p[er]formi ng the aforesaid rent and other services or any part of them or any of them t hat then his Majesty his heires, Successors [and] Assignes may distreine for the same and the said Manus his heires or Assignes shall att his or the ir proper costs and chardges within five yeares now next com[m]inge, ere ct and build and fully finish up[p]on the premisses one sufficient [and] substant ial house of timber stone or bricke after the fashion of an English howse two stories high att the least and conteininge sixe Roomes att the l east and that the said Manus or some other able and sufficient T enant with his ffamily shall from tyme to tyme from and after the building of the said howse for and duringe the space of one and tw enty years now next followinge be resident and inhabitant in an d upon the aforesaid howse and premisses, And shall w ithin five yeares now next ensuing att his and their owne prop[er] costs and charges well and sufficiently with ditches and quicksett where quicksett will grow and with other good and sufficient ffences and inclosures where quicksett will not grow sever and part all the said premi ses from the other lands of his Ma[ies]ty and his Ten[a]nts and from the lands of other persons near adioyninge unto the p[re]misses, and th e same shall from time to time preserve and keepe, And that the said Manus his heirs or assigns shall not nor will not demise or lett the p remises or any part thereof nor voluntarily, nor willingly suffe r the same or any part thereof to come to the hands or possession of any person or persons whatsoever that shall not then before have take en the oaths of allegiance and supremacy before some Iustice of P eace or others in that behalf lawfully authorised And the said Man us shall upon reasonable request have assigned and sett out to him by the Woodward or other Officer of his Majesty so much good and suf ficient rough timber in and upon the premises if the same be ther e to be had as shall be fit and necessary to be used in the buildinge of t he said house [...] oth[...] for him his heires [...] that [...] nd his heires shall [...] bee[...] in him by th[...] O Cahan [...] his last will [...] inge the fo resaid premisses or any part [...] one yeare a[...] or conveyance made by his Ma jesty [...] to the said Manus and his heires or assignes [...] agreem[en]t convey the foresaid p[re]misses in such manner [...] and for such estate and estates, as the same are [...] menc[i]oned the said will to be settled [and] conveyed And shall [...] p[er]forme the said will according to the [...] d meaning thereof as concerninge the foresaid [...] further agreed by the said Com[m]issioners and [...] and that his Ma[ies]ty will be gratiously pleased by letters patents under the great seale of England to ratify and
that is to say that he the said Manus O’Cahan and his assigns shall grind at the said mill or mills and not elsewhere, all the corn and grain that shall be used or spent in or upon the premises or any part thereof, and yielding and giving the sixteenth part thereof for the multure thereof. And for default of paying, doing, and performing the aforesaid rent and other services or any part of them or any of them, that then his Majesty, his heirs, successors, and assigns may distrein forthe same, and the said Manus, his heirs or assigns shall, at his or their proper costs and charges within five years now next coming, erect and build and fully finish upon the premises one sufficient and substantial house of timber, stone, or brick after the fashion of an English house two stories high at the least and containing six rooms at the least, and that the said Manus or some other able and sufficient tenant with his family shall, from time to time from and after the building of the said house, for and during the space of one and twenty years now next following, be resident and inhabitant in and upon the aforesaid house and premises. And shall, within five years now next ensuing at his and their own proper costs and charges, well and sufficiently with ditches and quicksett where quicksett will grow or with other good and sufficient fences and enclosures where quicksett will not grow, sever and part all the said premises from the other lands of his Majesty and his tenants, and from the lands of other persons near adjoining unto the premises, and the same shall, from time to time, preserve and keep. And that the said Manus, his heirs or assigns shall not nor will not demise or let the premises or any part thereof, nor voluntarily nor willingly suffer the same or any part thereof to come to the hands or possession of any person or persons whatsoever that shall not then before have takeen the oaths of allegiance and supremacy before some Justice of Peace or others in that behalf lawfully authorised. And the said Manus and shall, upon reasonable request, have assigned and set out to him by the Woodward or other Officer of his Majesty, so much good and sufficient rough timber in and upon the premises if the same be there to be had as shall be fit and necessary to be used in the building of the said house.
