those severall peeces or parcells of the Townelands called the two Ballimc Comes or one of them and now or late in the tenure or occupac[i]on of the said Richard Webb or his assignes and conteining by estimac[i]on three hundred ninetie and nine acres Irishe measure in Balliscullen aforesaid and allsoe all those severall peeces or parcells of the Towneland called Mullaboy conteining by estimac[i]on And several courts of piepowder in the said market and fairs respectively during the continuances of them and every of them, and receive and take all and singular tolls, perquisits, profits, commodities, emoluments, liberties, freedoms, customs, jurisdictions, and preheminences whatsoever to the said fairs, market, and courts, and to every or any of them belonging or respectively appertaining. Excepting and reserving out of this contracts and agreement all that messuage or tenement, kill-house, barn, stable, and other edifices and buildings lately erected and built by Richard Webb at his own proper costs and charges, and the garden, orchard, and backside thereunto belonging or adjoining, situate and being in the parish of Ballyscullion in the late county of Londonderry and now or late in the tenure or occupation of the said Richard Webb or his assigns, and also all those several pieces or parcels of the townlands called the two Ballimc Comes [Ballymacombs Beg and Ballymacombs More], or one of them, and now or late in the tenure or occupation of the said Richard Webb or his assigns and containing by estimation three hundred ninety and nine acres Irish measure in Ballyscullion aforesaid, and also all those several pieces or parcels of the townland called Mullaghboy, containing by estimation three-score and sixteen acres Irish measure in Ballyscullion aforesaid and now or late in the tenure or occupation of the said Richard or his assigns, and also one messuage or tenement lately built by Robert Stephenson at his own proper costs and charges, and the stable, edifices and buildings, backside, garden, and orchard, and one piece or parcel of land with the appurtenances thereunto adjoining or belonging in Ballyscullion aforesaid, containing by estimation four acres Irish measure and now or late in the tenure or occupation of the said Robert or his assigns, and also all those several pieces or parcels of the townland called the two Bally mc Combes [Ballymacombs Beg and Ballymacombs More], or one of them, and containing by estimation one hundred four-score and three acres Irish measure in Ballyscullion aforesaid and now or late in the tenure or occupation of the said Robert or his assigns, and all that messuage or tenement in part lately built by Ambrose Lewin at his own proper costs and charges, and the stable and other edifices and buildings, backside, garden, and orchard thereunto belonging or adjoining, and one parcel of land containing by estimation one acre and an half Irish measure, with their appurtenances in Ballyscullion aforesaid, and now or late in the tenure or occupation of the said Ambrose or his assigns, and also all those pieces or parcels of the townland called Killyberry containing by estimation forty acres Irish measure in Ballyscullion aforesaid and now or late in the tenure or ocupation of the said Ambrose or his assigns, and excepting and always reserving to his Majesty, his heirs and successors all donations, presentations, and gifts of advowsons, churches, vicarages, and chapels, and all his Majesty’s woods in Glenconkeyne and Killetra, and also all timber and timber trees, mines, and quarries in, upon, belonging, or appendant to the foresaid premises or any part thereof, and all such reasonable ways and passages over the premises for the tenants and occupiers of his Majesty’s other lands as have formerly been used, and all the River of Bann with all other rivers, creeks, and streams in or near the premises, and the soil and ground thereof, and all the fishings and taking of salmon, eels, and other fish in the said rivers, creeks, and streams and every or any of them, with free liberty for his Majesty, his heirs and successors and his and their tenants, farmers, and fishers of the said rivers, creeks, and streams to make houses and draw their nets and do any other thing else whatsoever upon the premises concerning the said fishings.
